- The Tel Aviv Museum of Art (the “Museum” or “we”) is a public benefit corporation, company registration number 520002320, located at 27 Shaul HaMelech Boulevard, Tel Aviv-Yafo. The Museum is the controller of the database(s) containing the information provided to it under this privacy policy.
- Definitions – in this privacy policy:
2.1. “Use of the Website” – the use of, or an attempt to use, the website located at www.tamuseum.org.il, and/or the landing pages, and/or any other digital platform of the Museum.
2.2. “Contacting the Museum” – any communication with the Museum that is not conducted via the Website, through any channel, including telephone, email, SMS, WhatsApp, social networks, in person, and the like.
2.3. “User”, “you” – any person who makes use of the Services as defined below, including anyone who uses the Website and/or communicates with the Museum by means of Contacting the Museum.
2.4. “Services” – all activities of the Museum for Users, including the staging of exhibitions; hosting events, tours, workshops, courses, classes, summer camps, and various activities; screening movies; operating the art library; renting out spaces; managing the “Friends of the Tel Aviv Museum of Art” community; and providing information about the Museum’s activities, consultation, or other services, whether within the framework of the Use of the Website or within the framework of Contacting the Museum. - Use of the Website and/or the submission of personal information about you indicates your consent to this privacy policy, as well as to the terms of use (“Terms of Use”) of the Website, and in accordance with any law that applies or will apply to the reasonable use of the Website and/or the Services. If you do not agree to any provision of the privacy policy or the Terms of Use of the Website, please refrain from continuing to use the Website and/or the Services.
- The Museum reserves the right to update the privacy policy from time to time, at its sole discretion and without prior notice. The updated privacy policy shall take effect immediately upon its publication on the Website. Notwithstanding the foregoing, insofar as material changes are made to this policy, a notice to that effect will be published on the Website. Your continued browsing of the Website and acceptance of the Museum’s Services following an update regarding such changes will indicate your consent to these changes and to the updated privacy policy.
Provision of information and the consequences of non-provision - The Museum respects your privacy. Within the framework of the Services, personal information about you will be collected—meaning information that identifies or may enable your identification. Personal information is collected when you provide it to the Museum within the framework of Contacting the Museum, as well as information that is collected automatically within the framework of the Use of the Website by means of data collection technologies as detailed in this policy.
- You acknowledge that there is no legal obligation to provide personal information, unless explicitly stated otherwise; however, the non-provision of certain information, or the failure to provide full and complete information, may prevent the Museum from providing you with the requested Services. The provision of information (including by means of continued browsing or making use of the various services) constitutes consent to its processing in accordance with the privacy policy. If you do not agree to the terms specified herein, you must cease all use of the Services.
Categories of data, method of collection and storage location - The Museum processes, among other things, data regarding the content and information transmitted about you within the framework of the use of the Services, as well as any information and/or data about you and/or others related to you (whether provided by you or provided by others).
- Personal information provided by you –
8.1. The information collected in the context of receiving Services and when Contacting the Museum may include, among other things: personal details (name, address, phone number, email address, ID number, date of birth), business details (company name and registration number), contact information, the content of conversations and correspondence, username and password (from Users registered on the Website), payment details (to the extent that a payment is made on the Website), business and financial information, and any other information.
8.2. Contacting the Museum through various channels – The information you provide when contacting the Museum and/or its representatives by means of a telephone inquiry and/or the WhatsApp platform and/or social media and/or other channels, including your phone number, the content of the inquiry and correspondence, and files uploaded by you, are stored in the Museum's systems. The use of WhatsApp and/or social media and/or other channels is subject to the privacy policy and terms of use of those providers, as updated from time to time. We hereby clarify that we bear no responsibility for the processing of data by other providers. For further information regarding the privacy practices of those providers, please refer to their privacy policy documents and/or terms of use. Additionally, inquiries sent to the Museum may be saved and/or recorded for quality control and service improvement purposes.
8.3. Extracurricular programs, courses, workshops, and events (“Activities”) – Upon registration for Activities organized by the Museum, we collect your full name, email address, mobile phone number, and any additional information as appearing on the dedicated registration form. In the case of registering children for extracurricular programs, information about the child will also be collected, including age, medical information (such as allergies and other medical limitations, as applicable), and the contact details of the parents (or guardians). Additionally, we may retain information regarding participation in extracurricular programs and events, including dates, times, frequency of participation, and attendance or non-attendance. In the framework of renting spaces at the Museum, the company/organization name will also be collected, where relevant.
8.4. Purchases and processing of payments – In the framework of purchases and processing of payments, we collect order and purchase details, personal details such as full name, identification number, email address, addresses (where necessary), and phone number, as well as any additional information that may be required at the time of making the purchase and/or payment and marked as a mandatory field. Upon completion of the above details, you will be redirected to a secure payment processing page and asked to complete the payment method details with which you will carry out the purchase or payment. The Museum does not customarily retain payment method details (except for the last four digits of the credit card) in the databases it owns. Payment processing services are carried out by means of third parties, and this information is stored with them in a secure manner, in accordance with their privacy policy and in accordance with the relevant standards. Information regarding the Services you have purchased and/or the payment you have made will be retained in the Museum's systems.
8.5. Submission of CVs and recruitment processes – When submitting an application for a vacant position at the Museum, as part of an open call for artists or for volunteering, you will be asked to provide details about yourself, including your full name, email address, mobile phone number, information regarding your education and employment experience, professional skills, as well as any additional information contained in your CV, your portfolio, or other documents attached by you in the framework of submitting your application. Additionally, we may retain information collected in the framework of reviewing your candidacy, such as information provided to us by references or provided by you in the framework of interviews and conversations with the Museum.
8.6. Donations – In the framework of making donations to the Museum, we may collect personal details such as full name, identification number, email address, addresses (where necessary), phone number, information relating to the donation amount, and any additional information that may be required at the time of making the donation. Upon completion of the above details, you will be redirected to a secure payment processing page and asked to complete the payment method details with which you will carry out the payment. The Museum does not customarily retain payment method details (except for the last four digits of the credit card) in the databases it owns. Payment processing services are carried out by means of third parties, and this information is stored with them in a secure manner, in accordance with their privacy policy and in accordance with the relevant standards. Alternatively, it will also be possible to complete the donation and transfer of funds by means of a bank transfer. - Personal information collected automatically – In addition, insofar as Use of the Website is concerned, the Museum also collects personal information that is not collected from you directly, such as: information about the device and its use, IP address, usage analytics, crash and error reports, browser and device characteristics, information about operating system functionality, language preferences, URLs, location, information about the manner and time in which you make Use of the Website and your use of the internet before and after such use, content preferences, other technical information and/or statistical information that does not personally identify you. The Museum is entitled to transfer statistical information about your activity on websites as aforesaid to third parties, including advertisers. Statistical information that is transferred will not personally identify you.
Data collection technologies on the Website - It is possible that in the framework of your contacting the Museum or in the framework of your use of the Services, additional information will be collected by the Museum and/or anyone on its behalf, automatically and/or from the context of the matter, including the date and duration of the inquiry, and the manner of the inquiry, namely the communication channel through which the inquiry was made.
- Additionally, certain monitoring technologies may be used, such as cookies, pixels, tags, and scripts embedded on the Website. Cookies are text files stored on the User's device and are used to record and retain data. Such data may include, among other things, information or personal information, intended to provide usage data about the Website and/or regarding the Services. These files may remain installed on the User's device after the User has logged out of the Services, in order to be activated upon the User's subsequent visits to the Website and/or for the purpose of receiving the Services.
- These technologies (hereinafter collectively “Cookies”) collect and analyze data regarding the manner of Use of the Website for the purposes set out below. Some of the Cookies are operated by us (“First-party Cookies”) and some are operated by external partners who provide us with data analytics, advertising, and marketing services (“Third-party Cookies”), who may also make use of the information collected for the business purposes of those third parties, in accordance with their privacy policy. Essential Cookies. Used for the ongoing operation and to ensure the proper functioning and security of the Website. These Cookies do not collect information that may identify you or information that can be associated with you (targeting).
Performance and statistics Cookies. Used to measure the manner of Use of the Website with the aim of analyzing, evaluating, and improving its performance. They enable the Website to understand how visitors use the various pages, how much time they spend on the Website, and which content is more popular, as well as to derive insights that enable us to maintain, measure, and improve our marketing, advertising, and sales activities. For this purpose, we embed Third-party Cookies such as Google Analytics.
Operational Cookies. Used to remember the settings and choices made by the User, with the aim of improving the user experience. These Cookies enable, among other things, the retention of the interface language, design settings, login details, and the operation of essential functions on the Website.
Marketing and advertising Cookies. Used to display advertisements and content tailored to your areas of interest, including on websites and services of third parties, based on your browsing and usage history on the internet. For this purpose as well, we embed Third-party Cookies such as social media platform Cookies and Google Ads.
Purposes of information collection and use - The Museum shall be entitled to process personal information about you for the purpose of carrying out actions related to the Services as well as for its ongoing operations. For example, the Museum will process the information for the following purposes:
13.1. Identification of the User, the User's history of use of the Website and/or the application, the User's preferences, as well as for establishing a verified and valid user account for the User;
13.2. For the purpose of the user experience on the interactive platforms and the Services offered therein;
13.3. Provision of the Services offered on the Website and/or the application, responding to User inquiries, providing information and support, handling issues, managing relationships with existing and potential customers, as well as documenting and tracking all of the foregoing;
13.4. Contacting the User for operational purposes in connection with the provision of the Services, such as invoices, order summaries, digital tickets, and the like;
13.5. Contacting the User for marketing purposes, invitations to events, feedback and surveys, newsletters, offering guided tours, notifications and updates, subject to the User's consent and the provisions of applicable law;
13.6. Operation and improvement of the Website and the Services;
13.7. Protection of the rights, property, and interests of the Museum and of third parties, protection of the safety of Users and the Museum, and defense against claims, demands, and legal proceedings;
13.8. Compliance with legal requirements, regulations, judicial decisions, internal procedures, and any law applicable to the Museum;
13.9. Information security, including the detection and analysis of malicious code and cyber-attacks, monitoring of security threats, and the adaptation of security solutions for the prevention of attacks.
Sharing information about you with third parties - The Museum shall not transfer to third parties the personal information and statistical information collected about the User on the Website, except in one of the cases set out below, and the User shall have no claim or demand against the Museum in respect of the disclosure of their details as aforesaid:
14.1. If the Museum has requested the User's permission and the User has given their explicit consent thereto;
14.2. If the disclosure of personal information is to agents of the Museum and/or those acting on its behalf, including service providers of the Museum, for the purpose of providing the Services and/or operating the Website and/or operating the Museum's marketing activities. It is hereby clarified that the Museum requires all service providers engaged to perform services on behalf of the Museum to agree to process personal information about you in accordance with the Museum's privacy policy;
14.3. In order to identify, prevent, or address security or technical issues, as well as in situations where the Website is being used by someone who appears not to be authorized to use the Services, in order to prevent fraud and impersonation;
14.4. If the User has performed an action on the Website which, in the Museum's opinion, is contrary to law or contrary to the Terms of Use;
14.5. In order to comply with any law, including in response to a legal proceeding, disclosure order, or request by a court or any competent tribunal or other authority, directing the Museum to provide your details or the personal information about the User to the court, tribunal, or other competent authority, or to any third party;
14.6. In the event of a dispute, claim, lawsuit, demand, or legal proceedings between the User and the Museum and/or anyone on its behalf, as well as in the event that the Museum considers that the disclosure of personal information about you is necessary in order to prevent harm to its rights or to the rights of third parties;
14.7. In the framework of collaborations with companies that have a business relationship with the Museum.
14.8. If the Museum operates its Services within the framework of another corporation — as well as in the event that the Museum merges with another entity or merges its activities with those of a third party, whether in full or in part — it shall be entitled to transfer to the new corporation or said third party the information stored about you in the database, or any statistical information in its possession, provided that such corporation or third party accepts upon itself the provisions of the Museum's privacy policy or provisions of equivalent substance.
14.9. In addition, the Museum may transfer information that does not personally identify you (for example, statistical or aggregated information), whether for consideration or without consideration, to third parties with whom it maintains business or other relationships, for any purpose. - Information about you that will end up outside the jurisdiction of Israel, including places where the laws relating to privacy and data security may not be as comprehensive as those in effect in Israel, shall be transferred in accordance with the Privacy Protection (Transfer of Data to Databases Outside the State Borders) Regulations, 5761-2001.
Mailings and publications - The Museum may contact you (itself or through anyone on our behalf) for the purpose of sending operational messages necessary for the provision of the Services, in any form and by any means, including by telephone and/or email and/or push notifications and/or text messages and/or any other means, including invoices, order summaries, digital tickets, and the like.
- Subject to your consent and/or request to receive marketing messages and advertisements on behalf of the Museum, the Museum may contact you (itself or through anyone on its behalf), in any form and by any means, including by telephone and/or email and/or push notifications and/or text messages and/or any other means, including for the purpose of sending direct mail messages as defined in the Privacy Protection Law and advertising matter as defined in the Communications (Telecommunications and Broadcasting) Law, 5742-1982 (“direct mail” and “advertisements” respectively) and/or invitations to Activities and events at the Museum, subject to the provisions of applicable law.
- If you do not wish to continue receiving direct mail messages and/or advertisements as aforesaid, you may, at any time, withdraw your consent as aforesaid and request your removal from the mailing list, and we will delete the personal information about you from the database used for direct mail. Third-party links and advertisements - Third-party links – The Website may contain links to websites of various third parties. The links appearing on the Website are not to be construed as a recommendation to use them, and they are included on the Website for your convenience only. When you navigate to a third-party website, you are subject to the privacy policy and terms of use of that website, and we therefore recommend that you review them carefully and consider whether they are suitable for your needs prior to browsing that website. The Museum is not responsible for the content of websites to which links exist on the Website or for the quality of the service provided therein, and it shall bear no liability whatsoever in connection with such websites.
- Third-party advertisements – The Museum may permit other companies to advertise their products or services on the Website. Such advertisements originate from those companies' computers. In order to manage their advertisements, these companies may place Cookies on your computer or mobile device. The Cookies enable them to collect information about the use of the relevant products on which you have viewed advertisements, as well as which advertisements you have clicked on. The use that these companies make of Cookies is subject to their own privacy policy and not to this privacy policy. Data retention period - We retain personal information that is required by us for the purpose of providing the Services and for the purposes set out above, in order to support our ongoing business operations in accordance with the Museum's procedures and as required by law. In addition, we may continue to retain your personal information where there is a need to do so, for example, in preparation for possible legal proceedings, or for documentation and archiving purposes and other legal needs. Your personal information will be stored in the Museum's database, which may also be held and managed on its behalf by a third party.
Information security - The Museum places great importance on protecting your privacy and makes reasonable commercial efforts in the circumstances in order to secure the personal information you provide to us. The Museum reserves the right to modify and update these security measures while maintaining the level of security of the personal information. Notwithstanding the foregoing, while these measures reduce the risks of unauthorized access to the Museum's computers, there is no absolute security or electronic storage method that is 100% secure or protected. The Museum cannot guarantee that unauthorized access to the Website or its systems will not occur. If you believe that the personal information about you may be exposed to unauthorized parties, you must notify the Museum immediately by contacting us via the details below.
- You bear full and sole responsibility for all actions carried out through the use of your personal identification details (such as username and password) for the Museum's Website systems and Services. It is therefore recommended that you keep your identification details confidential and not disclose them to any third party. Should you choose to share this information with a third party, you shall bear full responsibility for all actions carried out through the use of your identification details. You furthermore undertake to notify the Museum immediately of any concern regarding unauthorized use of your identification details and/or any other breach of confidentiality or privacy related to your account.
Minors - As a general rule, the Services are intended for Users above the age of 18. Miscellaneous - If it is determined by a final and conclusive judgment or judicial decision that any part of this privacy policy is invalid, that part alone shall be void and all remaining parts of the privacy policy shall remain in force and continue to be binding upon you.
